1. This sweepstakes for a 2010 Nissan Altima is provided by John Marazzi Nissan. By entering this Promotion, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification. All decisions of the judges regarding this Promotion are final and binding in all respects.
2. PROMOTION PERIOD. Promotion begins on December 1, 2009 at 12:01 AM EST and ends on December 15, 2010 at 11:59 PM EST when all entries must be received ("Promotion Period"). All text entries must be received on or before December 15, 2010 at 11:59 PM EST. Drawing will be held at John Marazzi Nissan on or before December 31, 2010 and finalist must be present to win.
3. ELIGIBILITY. This sweepstakes (the "Promotion") is only open to legal residents of THE STATE OF FLORIDA who have a valid U.S. Drivers License who are at least 18 years old as of the date of entry, except officers, directors, members, and employees of the Sponsor, the judging organization (if applicable), or any other party associated with the development or administration of this Promotion, and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household, as such individuals. This Promotion is void outside the STATE OF FLORIDA, and where prohibited.
4. HOW TO ENTER & NOTICE TO TEXT MESSAGING CONTESTANTS. This is a text in only promotion. To participate you must TEXT "NISSAN" to 333222 during the Promotion Period and follow the instructions to complete and submit your registration via text message. All entries become the property of the John Marazzi Nissan and will not be acknowledged or returned. Limit: One entry per person (text) and per cell phone number during the Promotion Period. All entrant information, including e-mail addresses, address, and Cell phone number is subject to the respective Privacy Policy of the applicable Sponsor to enter via text message. To enter via text message, you will need to TEXT: "NISSAN" TO: 333222 to opt-in to participate. By submitting an entry via text message, you are giving your express authorization to receive up to six (6) future text messages per month relating to the sweepstakes and Join the John Marazzi Nissan mobile alerts club to receive other types of special offers from John Marazzi Nissan. Those entering via text messaging, will be charged standard text messaging rates for any text message that originates from or is received by your phone according to the terms in your Calling Plan with your Carrier plus any additional charges if applicable and disclosed to you via text message or other promotional message. You must have a text messaging two-way capable phone and digital service to enter using the text messaging method. Text Messaging is not available in all markets and may not be available through all Carriers. In the event of a dispute over the identity of an entrant who has entered via text messaging, entry will be deemed submitted by the authorized account holder of the Mobile Telephone Number phone account ("MTN") as of the date entry was made. An authorized account holder of the MTN is deemed to be the natural person who is assigned a MTN by the Carrier or as shown on the Carrier's records. The participating entrant is solely responsible for any costs related to text message entry. All mass entries or entries generated by a script, macro, or use of automated devices will be disqualified. If you opt out of the program before the December 31, 2010, you will not be eligible to win any prize.
No responsibility is assumed for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, wireless, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmissions of or failure to receive entry information by sponsor or presenter on account of technical problems or traffic congestion on the Internet or via mobile phone transmission or any combination thereof. No responsibility assumed for any injury or damage to entrant's or any other person's computer/mobile device related to or resulting from playing or downloading any materials in the sweepstakes.
Caution: Any attempt to deliberately damage any service or Web site or to undermine the legitimate operations of the sweepstakes is a violation of criminal & civil laws. Should such an attempt be made, the Judges and/or Presenting Promoter(s) reserve the right to disqualify such entrant & to seek damages from any such person to the fullest extent of the law. In the event the Sweepstakes is, in the opinion of the Presenting Promoter or Judges, compromised by a virus, bugs, non-authorized human intervention or other causes beyond the control of the Presenting Promoter or Judges, which corrupts or impairs the administration, security, fairness or proper play of the Sweepstakes, the Judges and/or Presenting Promoter(s) reserve the right in its/their sole discretion to modify, suspend or terminate the text messaging method of entry of the Sweepstakes.
5. DRAWING AND PRIZE INFORMATION: Each month for 12 months one random drawing will take place via text message only that identifies one (1) of twelve (12) potential finalists that will be randomly drawn each month. All twelve (12) finalists will be eligible to win the 2010 Nissan ALTIMA. On or before December 31, 2010 all finalists will participate in a random drawing on site at John Marazzi Nissan, whose decision is final in all matters. The finalists will be notified by Text only. If a potential winner cannot be contacted, does not respond within five (5) days from the date the Sponsor first tries to notify him/her, and/or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the 2010 Nissan ALTIMA or receive the prize, and an alternate finalist may be selected. Upon contacting a finalist and determining that he/she has met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a "finalist" of the Promotion. One (1) Prize Winner will receive a 2010 Nissan ALTIMA. The Approximate Retail Value (ARV) of the 2010 Nissan ALTIMA is $24,365.00 before taxes, title, license, and fees. The Prize Winner will be selected by a random drawing from all eligible entries received during the Promotion Period. Odds of winning depend on the number of eligible entries received for the Sweepstakes.
Each month's finalist will be notified by text message only on or before the fifteenth (15th) of the following month that they have qualified for the final drawing held on or before December 31, 2010. The Finalist that is selected to win must take delivery of the vehicle in person within thirty (30) days of such notification at the John Marazzi Nissan, located at 3640 Pine Ridge Rd. Naples, FL 34109.
The finalists and official winner will be required to sign and return an affidavit of eligibility, a liability / publicity release, and any other release reasonably requested by Sponsor to receive his/her 2010 Nissan ALTIMA. Failure to (i) take delivery of the 2010 Nissan ALTIMA within the time period provided above, (ii) sign and return an affidavit of eligibility, a liability / publicity release, and any other release reasonably requested by Sponsor, and/or (iii) comply with these Official Rules will cause forfeiture of, and a loss of all claims and rights to the 2010 Nissan ALTIMA. Thereafter, Sponsor may select an alternate winner.
The 2010 Nissan ALTIMA will be delivered with a standard base model package. Any additional options are Prize Winner's responsibility. The 2010 Nissan ALTIMA color is intended to be silver, but such color is subject to availability. Any vehicle displayed at events or pictured in promotional/advertising materials may not be the actual vehicle awarded. Manufacturer's standard limited warranty applies to the 2010 Nissan ALTIMA. Prize Winner is solely responsible for any expenses in connection with the 2010 Nissan ALTIMA not expressly described herein as being awarded including, without limitation, the following: (i) all taxes, including but not limited to income, federal, state, and local taxes; (ii) vehicle sales tax, title, license, and fees; (iii) insurance, registration fees, delivery charges, dealer preparation fee and/or additional options, additions or equipment; and (iv) any additional expenses not described herein as being awarded. The Prize Winner will be issued an IRS Form 1099 to report his/her winnings. The Prize Winner must have a valid U.S. drivers license and proof of insurance to take delivery of the 2010 Nissan ALTIMA.
The 2010 Nissan ALTIMA may not be substituted transferred or redeemed for cash. In case of unavailability, Sponsor reserves the right to substitute a prize of equal or greater value. Neither Sponsor nor their respective directors, employees, or agents, have made nor are in any manner responsible for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the 2010 Nissan ALTIMA, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties, representations, and/or guarantees on the 2010 Nissan ALTIMA(if any) are subject to the respective manufacturer's terms therefore, and the Prize Winner agrees to look solely to such manufacturer for any such warranty, representation and/or guarantee.
6. WINNER SELECTION, FINALIST SELECTION, AND NOTIFICATION. Winner selection will be conducted by random drawing from the twelve (12) finalists selected from the text entries on or before December 31, 2010 (the "Drawing Date"). If any of the finalists cannot be present for the random drawing to be held on or about December 31, 2010 (the Drawing Date"), they will forfeit their right to win and the Sponsor shall have the right to select a new finalist. Upon selection of the winner and determining that he/she has met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a "winner" of the 2010 Nissan ALTIMA. 7. TAXES. All federal, state, and/or local income and other taxes, if any, are the winner's sole responsibility.
8. ODDS OF WINNING. The odds of winning this Promotion depend on the number of eligible entries received.
9. NO PRIZE TRANSFER OR SUBSTITUTION. No prize or any portion thereof is transferable or redeemable for cash. Any portion of the prize that is not used is forfeited. No substitutions for prize except by Sponsor, in which case a prize of equal or greater value will be substituted.
10. CONSENT AND RELEASE. By entering the Promotion, each entrant releases and discharges the Sponsor, judging organization (if applicable), and any other party associated with the development or administration of this Promotion, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, "Sponsor Entities"), from any and all liability whatsoever in connection with this Promotion, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, "Claims"). Except where prohibited: (i) acceptance of a prize constitutes the consent of any winner, without further compensation, to use the name and likeness of such winner for editorial, advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor; (ii) acceptance of a prize constitutes a release by any winner of the Sponsor Entities of any and all Claims in connection with the administration of this Promotion and the use, misuse, or possession of any prize; (iii) any potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity release; and (iv) if prize involves travel or activities, any potential winner and travel companion (if applicable) may be required to execute releases of the Sponsor from any and all liability with respect to participation in such travel/activities and/or use of the prize. Affidavits and releases must be signed and returned by all finalists and official winner within ten (10) days from the date that Sponsor first tries to notify the potential winner. If winner is deemed to be a minor under the jurisdiction of his/her residence, the prize will be awarded in the name of his/her parent or legal guardian who must execute the necessary affidavit and release and, if applicable, must accompany winner on the trip (no additional travel expenses will be awarded should a parent or legal guardian be required to accompany the winner on the trip).
11. DISCLAIMERS. (i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor's servers or elsewhere, will not be eligible. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the cell phone number submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to the cell phone number as noted above in item number 4. Sponsor has the right to change the terminology of the promotion. (ii) Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the web site. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Sponsor. (iii) Sponsor further reserves the right to cancel, terminate or modify the Promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. (iv) Sponsor Entities are not responsible for errors in the administration or fulfillment of this Promotion, including without limitation mechanical, human, printing, distribution, or production errors, and may modify or cancel this Promotion based upon such error at its sole discretion without liability. (v) SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. (vi) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
12. APPLICABLE LAWS AND JURISDICTION. This Promotion is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by the laws of the State of Florida. All disputes arising out of or connected with this Promotion will be resolved individually, and without resort to class action, exclusively by a state court located in Naples, Florida. Should there be a conflict between the laws of the State of Florida and any other laws, the conflict will be resolved in favor of the laws of the State of Florida. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental and/or consequential damages.
